Mediation is a positive form of alternative dispute resolution. It is a process wherein adverse parties in a lawsuit agree to resolve their case by using a mediator who acts as a referee that facilitates a resolution of the dispute.
Mark Anthony Gager is certified by the Florida Supreme Court as a mediator. As a trial lawyer, he has handled thousands of cases involving personal injury, wrongful death and head injury lawsuits, as well as criminal defense, entertainment and sports law, and general civil litigation. Mr. Gager is highly skilled in mediation, negotiation techniques and alternative dispute resolution. There are many benefits to mediation as opposed to litigation. The more adversarial route of litigation is costly, uncertain and filled with delay. Mediation assures the parties a certain degree of control over the settlement. In this way, it is “proactive” since the parties are able to obtain and present the best information in support of the claim. Mediation offers in-person informal meetings so claimants could “have their day in court” by being able to explain the magnitude of their loss and their views without the constraints of the courtroom and the rules of evidence and procedure. Finally, a mediated resolution offers certainty without delay and provides closure.
As a result, mediation is now court-ordered in many situations and has become an extremely cost-effective means of dispute resolution.
